JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Sugauli P.S. Case No. 221 of 2019 registered for the offences punishable under Sections 341, 353, 504/34 of the Indian Penal Code and Sections 33, 41, 42 of Indian Forest Act and Sections 1, 3, 5, 8, 9, 11, 13 & 14 of Bihar Caste Chiran Act.

Allegation against the petitioner is of illegally running of saw mill and when Forest Officials raided the place he was threatened by petitioner.

Submission of learned counsel for the petitioner is that he has falsely been implicated and moreover there is no material against him, rather allegation is general and omnibus in nature.

In view of above facts and circumstances, let petitioner surrender in the court below within two weeks from the receipt of this order and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari, in connection with Sugauli P.S. Case No. 221 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned and further condition is that petitioner has to co-operate in the investigation and appear before the police as and when required.
