2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 406, 420/34 of the Indian Penal Code.
3. As per F.I.R., this petitioner, who is transporter, along with co-accused Arjun Barman, driver of the truck bearing registration no. NL 01 G 1048 stole the rice of informant. It is alleged that informant loaded 500 packets of rice on the truck in question for delivery but the truck did not reach the destination and as such, petitioner along with other F.I.R. named accused persons committed theft of rice of informant worth Rs. 4,20,433/-.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner
Patna High Court CR. MISC. No.64369 of 2025(2) dt.16-09-2025 2/2 is neither driver nor owner of the vehicle in question and has got no concern with the alleged occurrence. It is further submitted that petitioner has not received single payment for transportation of rice as alleged in the F.I.R. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application and submitted that petitioner is transporter and booked the shipment of informant which got disappeared and did not reach the destination.
6. Considering the nature of accusation, prayer for anticipatory bail of the petitioner is refused. (Prabhat Kumar Singh, J) Navya/- U T
