Heard learned counsel for the petitioner and learned A.P.P. for the State.

Patna High Court CR. MISC. No.62873 of 2022(2) dt.25-02-2023 2/3 The petitioner seeks regular bail in connection with Amarpur P.S. Case No. 245 of 2022 lodged under Sections 420, 467, 468, 471, 120b of the I.P.C.

As per the prosecution case, the allegation against the petitioner is that she entered into the services on the basis of forged and fabricated documents. On the basis of which present Amarpur P.S. Case No. 245 of 2022 has been filed through officers of the Vigilance.

Learned counsel for the petitioner submits that petitioner is a lady and in paragraph-10 it has been categorically stated that she has already tendered resignation i.e. Annexure -2 (& Annexure-3) of the petition, to the Headmaster as well as to the D.P.O.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 17.09.2022 having clean antecedent. Charge has already been framed in this case. Learned counsel for the State opposes the prayer for bail and submits that the petitioner has already resigned from the services and in similarly situated cases, persons after resignation have been granted bail by the Co-ordinate Bench of this Court.

No.62873 of 2022(2) dt.25-02-2023 3/3 In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 245 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.

Trial court is directed to expedite the trial within nine months.
