2. The petitioner is in custody in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.

3. As per allegation in the FIR, total 40 liters of illicit liquor was recovered.

4. Learned counsel for the petitioners submits that petitioner has falsely been implicated in this case. He next submits that similarly situated co-accused has been granted bail by this Court passed in Cr. Misc. no. 20869 of 2024, he has no concern with the seized liquor and he is in custody since 30.07.2024.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In view of the aforesaid facts and circumstances of this case as also the fact that similarly situated co-accused has been granted regular bail by this Court, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise Court-I, Samastipur in connection with Vidyapati Nagar P.S. Case No. 03 of 2024.
