2. The petitioner is apprehending his arrest in connection with Bangra P.S. Case No. 48 of 2025 for the offence under Sections 126(2), 115(2), 352, 351(2), 118(1), 74, 85, 109(1), 303(2) and 3(5) of the BNS.
3. It is a case of matrimonial dispute between the petitioner and opposite party no. 2, wherein the informant has alleged that she was subjected to mental and physical cruelty by her in-laws.
4. Learned counsel for the petitioner submits that the petitioner is quite innocent and has committed no
Patna High Court CR. MISC. No.61900 of 2025(5) dt.24-12-2025 2/3 offences as alleged in the F.I.R. The petitioner has falsely been implicated in the present case out of malice and grudges. Petitioner is husband of the informant and due to strained relationship between the petitioner and informant, all the family members of the petitioner have been framed in this case. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
5. Learned APP opposes the prayer for bail.
6. During the chamber proceedings, the petitioner has expressed his willingness to keep his wife and child with him, with full honour and dignity; however, the wife has categorically refused to live with her husband at any cost. Keeping in view the aforesaid facts, and bona fide conduct of the petitioner, this Court is inclined to extend him the privilege of anticipatory bail.
7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the date of receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Samastipur, in connection
Patna High Court CR. MISC. No.61900 of 2025(5) dt.24-12-2025 3/3 with Bangra P.S. Case No. 48 of 2025 subject to the conditions as laid down under Section 482 of B.N.S.S., as also with the condition that one of the bailors should be close relative of the petitioner.
