2. Petitioner seeks regular bail in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act.
3. There is recovery of 16.785 litres illicit liquor from the sack and bag kept behind the house of petitioner. It is alleged that petitioner who had thrown the same on seeing the police party was apprehended by police at the place of occurrence.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case due to village politics. Nothing has been recovered from conscious possession of the petitioner. Petitioner has no concern
Patna High Court CR. MISC. No.61257 of 2025(2) dt.24-09-2025 2/2 with the seized liquor. The alleged recovery has been made from behind the house of petitioner which is an open place accessible to everyone. There is no independent witness of the seizure list. Petitioner has one criminal antecedent of different nature in which he is on bail. Petitioner is in jail since 12.07.2025 and he undertakes to cooperate in the investigation and trial.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case, the submissions of the parties and period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran at Motihari in connection with Govindganj P.S. Case No.165 of 2025.
