The petitioner apprehends his arrest in a criminal prosecution registered for offences under Sections 420 and 120B of the Indian Penal Code as also under Sections 27 (a), 28A and 23 (3) of The Drugs and Cosmetics Act, 1940.
Taking into consideration the fact that the petitioner is the sole accused named in the first information report vide Annexure-1 and further taking into consideration the fact that from the medical shop of the petitioner spurious drugs have been seized by the Drug Inspector and also taking into consideration the fact that the petitioner appears to be selling spurious drugs and playing with the life of common people, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of anticipatory bail. Accordingly, his prayer for grant of anticipatory bail in connection with Muzaffarpur (T) P.S.Case 480 of 2015 pending in the court of the learned Chief Judicial Magistrate, Muzaffarpur is rejected.
However, if the petitioner surrenders in the court
Patna High Court Cr.Misc. No.47908 of 2015 (3) dt.05-02-2016 2/2 below within a period of four weeks from today and applies for regular bail, then the same shall be considered on its own merits without being prejudiced by the rejection of his prayer for grant of anticipatory bail by the present order.
