The sole petitioner , who is in custody since 1.9.2016 in Kishanganj P.S. Case No. 408 of 2016 registered for the offence under Section 47/56 of the Bihar Excise Amendment Act 2016 has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner has falsely been implicated on an accusation of recovery of 4 liters 50 ml Indian make foreign liquor. He submits that it is true that petitioner was travelling on a bus and from upper portion a bag was recovered in which foreign liquor was kept. It has been stated by way of referring to paragraph no. 3 of

Patna High Court Cr.Misc. No.43081 of 2016 (2) dt.18-10-2016 2/2 the petition that petitioner is having clean antecedent. Keeping in view the nature of accusation and clean antecedent of the petitioner, let the petitioner Dipak Bharti be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj/ concerned court in connection with Kishanganj P.S.
