The petitioner apprehends his arrest in Complaint Case No. 776C of 2016, registered for the offence punishable under Section 498(A) of the Indian Penal Code.

The complainant alleged that she was married to the petitioner in the month of July, 2013 but, thereafter the petitioner and others subjected her to all sorts of physical and mental torture. Learned counsel for the petitioner submits that all the allegations are false. The petitioner tried his best to bring his wife to his own house but, the complainant-wife of the petitioner refused to accompany the petitioner. Thereafter, the petitioner filed Matrimonial Case No. 174 of 2016 on 13.06.2016 for

Patna High Court Cr.Misc. No.16230 of 2017 (2) dt.27-04-2017 2/2 restitution of the conjugal rights. When the complainant knew about the institution of the matrimonial suit, she filed this case on 28.07.2016. The petitioner is still ready to keep his wife. Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Bihar Sharif in Complaint Case No. 776C of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
