JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 21-02-2025 Heard learned counsel for the petitioner and Mr. Surendra Prasad Singh, learned APP for the State. 2.The instant application for anticipatory bail has been filed by the petitioner apprehending her arrest in connection with Bibhutipur P.S. Case No. 125 of 2024 instituted for the offence under Sections 302/34 of the Indian Penal Code.
3. The case of the prosecution is that Vinay Kumar Mishra, Sanjeet Kumar Mishra, Lal Babu Mishra, Shivam Kumar, Rinku Devi (petitioner) have committed murder of sister of the informant. It has further been alleged that the marriage was solemnized 23 years ago with Sanjeet Kumar Mishra. It has been stated that from two years, all the family members who are harassing the sister of the informant for bringing cash. In the
Patna High Court CR. MISC. No.73997 of 2024(4) dt.21-02-2025 2/3 last part of the F.I.R., it is stated that Prince Kumar Mishra has seen the occurrence.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Petitioner is the Gotani of the deceased and she has falsely been implicated in this case. She is living separately and she has got no concern with the affairs of the deceased and her family. The allegation agaisnt the petitioner is general and omnibus. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Similarly situated co-accused person has already been granted regular bail by this Court vide order dated 21.01.2025 in Cr. Misc. No.74377 of 2024.
5. In contra, learned APP appearing for the State has opposed the prayer of bail of the petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of her arrest or surrender in connection with Bibhutipur P.S. Case No.125 of 2024, she will be enlarged on bail on furnishing bail bond of Rs. 10,000/-
Patna High Court CR. MISC. No.73997 of 2024(4) dt.21-02-2025 3/3 (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Rosera, Samastipur subject to the conditions as laid down under section 438(2) of the Cr.P.C.
