The petitioner seeks regular bail in connection with Tatarpur P.S.Case No.76 of 2016 registered for offences punishable under Sections366(A) and 34 of the Indian Penal Code. The allegation against the petitioner is that he has kidnapped the daughter of the informant in collusion with the co-accused. It is submitted on behalf of the petitioner that the whole allegation is false and concocted and further it is submitted that except kidnapping, nothing else has been alleged against the petitioner. He is in custody since 11.11.2016. The learned counsel for the petitioner has submitted that the co-accused has already been granted bail by this Court.

Heard learned A.P.P. also and the learned counsel for the

Patna High Court Cr.Misc. No.17683 of 2017 (2) dt.17-04-2017 2/2 informant. They have stated that the victim girl in her statement made under Section 164 Cr.P.C. and other witnesses during the course of investigation have supported the case of the prosecution and the petitioner is main accused in this case. Having heard both sides. No doubt the co-accused has already been granted bail by this Court but the main allegation is against this petitioner.

Considering the aforesaid aspect of the matter, I am not inclined to grail bail to the petitioner, as such, the prayer for bail of the petitioner is dismissed.

Let the trial be expedited in this case.
