Learned Sr. Counsel for the petitioner submits that the prayer for regular bail of the petitioner has earlier been rejected vide order dated 01.11.2023 passed in Criminal Miscellaneous No. 69533 of 2023. Learned Sr. Counsel further submits that the allegation made in the F.I.R. is completely mismatched with the findings given in the post mortem report and the inquest report by virtue of which the case appears to be palpably false. Moreover, the informant is not the eye witness to the occurrence.
3. Learned A.P.P. for the State submits that on earlier occasions, a report with regard to the present stage of the case
Patna High Court CR. MISC. No.67607 of 2024(3) dt.06-12-2024 2/2 has been called for.
4. From perusal of report, it transpires that out of five witnesses, four chargesheet witnesses have already been examined and only the I.O. is left to be examined in this case.
5. As such, this Court is not inclined to grant bail to the petitioner.
6. Accordingly, the prayer for regular bail of the petitioner in connection with S. Tr. No. 681 of 2023, arising out of Rajgir P.S. Case No. 133/ 2023, pending before the learned Additional Sessions Judge-X, Nalanda, Biharsharif is hereby rejected.
7. However, the Superintendent of Police, Nalanda is directed to do the needful to ensure the appearance of the S.H.O./I.O. concerned of this case before the Court for completing the evidence within two months.
8. The Registry is directed to communicate a copy of this order to the Superintendent of Police, Nalanda forthwith through e-mail as well as any other mode.
