JUSTICE SUDHIR SINGH ORAL ORDER 03-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 498, 341, 323 and 506/34 of the Indian Penal Code. and Section 3 / 4 of the Dowry Prohibition Act.

Allegation against petitioner is of torturing and ousting from matrimonial house daughter of informant due to nonfulfilment of demand of dowry. It has been submitted on behalf of the petitioner that he is in custody since 6.6.2016. Chargesheet has been submitted against petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioner. Petitioner is husband of informant. There is adultery alleged by petitioner against informant before Gram Kachahari prior to institution of the present case. A divorce case is also pending in the family court. There is no chance of reconciliation between the parties.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like

Patna High Court Cr.Misc. No.42333 of 2016 (2) dt.03-10-2016 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Aurangabad (T) P.S. Case no. 288/2015.
