JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-09-2019 This is an application for grant of anticipatory bail in connection with Kadirganj P. S. Case No. 57 of 2019, disclosing offences under Sections 342, 323, 354B, 452, 504, 379 of the Indian Penal Code.

Allegation against the petitioner is that he entered inside the house of the informant and trying to outrage her modesty and on hulla, he snatched her Mangal Sutra from her neck and also abused her.

Submission of the learned counsel for the petitioner is that petitioner is next door neighbour and one day earlier, there was some dispute between them, as such, this false and concocted case has been lodged and the occurrence is said to be at 6:00 A.M., it clearly shows the falsity of the case. From the F.I.R. itself it appears the informant is a married lady. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Sri B. N. Tripathi, learned Judicial Magistrate, 1st Class, Masaurhi, in connection with Kadirganj P. S. Case No. 57 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
