02. 17.10.2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 302 and 504 of the Indian Penal Code and Section 27 of the Arms Act. It is contended on behalf of the petitioners that the main allegation of pressing neck causing death is upon Anuj Choudhary and so far as the other allegation of catching hold of leg or hands is upon the petitioner No. 1, Rakesh Choudhary. It is further contended that similarly situated other co-accused persons namely Madan Choudhary and Suruchi Devi @ Suruchi

Patna High Court Cr.Misc. No.42840 of 2016 (2) dt.17-10-2016 Kumari have already been granted bail vide Cr. Misc. No. 32801 of 2016 dated 30.09.2016 and Cr. Misc. No. 36930 of 2016 dated 14.09.2016. It is also contended that the charge-sheet has been submitted in the matter.

Having regard to the facts and circumstances of the case, the petitioners, namely, Rakesh Choudhary and Prem Choudhary are directed to be released on bail on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Bachhawara P.S. Case No. 202 of 2015.
