JUSTICE BIRENDRA KUMAR ORAL ORDER 10-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 272/273 of the Indian Penal Code and Section 47(a) of the Bihar Prohibition and Excise Act, 2016.
Raw Mahua for preparation of liquor was recovered from the possession of the petitioner. Petitioner has stated on oath that he has got no criminal antecedent and he is in custody since 20.11.2016. Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount
Patna High Court Cr.Misc. No.16807 of 2017 (2) dt.10-04-2017 2/2 each to the satisfaction of learned 14th Additional Chief Judicial Magistrate, Motihari, East Champaran/Successor Court, in connection with Pipra P.S. Case No.169 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
