This case has been listed at the instance of the petitioner for modification in the order dated 09.02.2020, as some facts have inadvertently been wrongly stated in the order.

The report dated 07.02.2022 of the trial court clearly indicates that only the case of five accused persons out of ten has been committed to the Court of Sessions for trial. Perhaps this statement was wrongly construed as five witnesses having been examined. However, looking at the nature of accusation against the petitioner and the fact that he was absconding for quite sometime, I am not inclined to

Patna High Court CR. MISC. No.2089 of 2022(4) dt.18-02-2022 2/2 grant bail to him during the pendency of the trial. Accordingly, the prayer for bail is rejected. However, the trial court is directed to frame charges against the petitioner forthwith if not already framed and proceed with the trial. If there is no substantial progress in the trial for the next six months, it would be open for the petitioner to approach this Court again for grant of bail.

The order dated 09.02.2022 is thus, modified to the extent indicated above.
