2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 147, 148 , 149, 341 , 323 , 504, 506 and 307 of the Indian Penal Code . 3 . Prosecution case in brief, is that on 19.04.2024, all the accused persons including these petitioners surrounded the bhaisur of informant and assaulted him. When the husband of informant came to rescue , in the meantime co- accused Arun Paswan assaulted him with sword on his head, co-accused Pramod Paswan assaulted on shoulder of Byas Paswan with

No.68627 of 2024(2) dt.23-10-2024 2/3 rod , co-accused Mantosh Paswan assaulted with iron pipe on back of Byas Paswan , co-caused C P Paswan assaulted Parikha Paswan with sword, co-caused Nagendra Paswan caught hair of Pushpa Devi and assaulted her with lathi, co-caused Sonu Paswan assaulted Ashok Paswan with bricks.
4. It is submitted on behalf of the petitioners that the petitioners are innocent and has falsely been implicated in this case . Specific accusation of overt act is against other coaccused persons and so far as these petitioners are concerned, there is no specific accusation of assault against them. Allegation is general and omnibus against these petitioners. There is case and counter case .
5. Learned counsel for the State oppose the bail petition.
6 Considering the general and omnibus allegation of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Aurangabad ( Bihar ) in connection with Phesar P.S. Case No. 40 of 2024 , subject to the conditions
