In this case, the petitioner is challenging the order containing memo no.1072 dated 19.07.2016, passed by the District Programme Officer (Establishment), Supaul, whereby and whereunder, the petitioner has been transferred to Upgraded Middle School, Parri, Block-Marauna, District-Supaul.

Patna High Court CWJC No.16398 of 2016 dt.05-09-2017 2/2 Leaned counsel for the petitioner submits that the petitioner has already joined the new post, but has made a prayer that his wife is also a teacher and as per the Government Circular they should stay at the same station.

This Court does not find any illegality in the impugned order as it is an administrative order. The petitioner, if so advised, may file a representation before the competent authority. If such a representation is filed by the petitioner, the authority concerned will be obliged to look into the grievance of the petitioner and pass order in accordance with law within a period of three months from the date of filing of representation by the petitioner. With the aforesaid observations and directions, this writ application is disposed of.
