The petitioner apprehends his arrest in connection with Koilwar P.S. Case No.95 of 2020, registered for the offence punishable under Sections 394 and 397 of the Indian Penal Code.

The allegation against the petitioner is that he alongwith other co-accused persons fired upon the truck of the informant due to which the driver of the said truck sustained injuries. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and have committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. He submits that the petitioner is not named

Patna High Court CR. MISC. No.64272 of 2022(2) dt.24-02-2023 2/2 in the FIR, during the course of investigation one person was apprehended by the police and he disclosed the name of the petitioner. There is no eye witness in the present case and police has indulged the petitioner in the present case merely on the basis of suspicion. Petitioner has two criminal antecedent. Learned APP for the State opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case as well as considering the nature of allegation, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. Accordingly, this application is dismissed.
