The petitioner seeks bail in connection with Excise Case No.1059 of 2021 arising out of Hulasganj P. S. Case No.191 of 2021, instituted for the offences under Section 353 of the I.P.C. and Section 30(a) of the Excise Act. The learned counsel for the petitioner submits that the petitioner is in custody since 21.11.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of recovery of 32 litre of liquor from the petitioner.

The learned counsel for the petitioner submits that petitioner has been falsely implicated. The real culprit fled after

Patna High Court CR. MISC. No.231 of 2022(2) dt.02-03-2022 2/2 seeing the police and throwing the liquor and the petitioner being a passer-by came to be implicated.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 500/- (Rupees Five Hundred) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Jehanabad in connection with Excise Case No.1059 of 2021 arising out of Hulasganj P. S. Case No.191 of 2021.

The application stands allowed.
