The Petitioner seeks bail in Amarpur P.S. Case No. 396 of 2016 registered for the offence punishable under Sections 304B, 120B/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The informant is the Father-in-Law of the petitioner who has alleged in the FIR that his daughter is missing and could not be traced and there is apprehension that his daughter has been killed by her in-laws and on the basis of such allegation FIR was registered.
The police investigated the matter and has submitted chargesheet under Section 364 of the IPC. The charges have also been framed under Section 364 of the IPC. It
Patna High Court Cr.Misc. No.16859 of 2017(5) dt.11-01-2018 2/2 has been further submitted by the learned counsel for the petitioner that the petitioner has got no criminal antecedent and is in custody since, 02.11.2016.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 396 of 2016.
