JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-10-2015 Heard learned counsel for the petitioner and the learned APP for the State.

This is an application for grant of regular bail on behalf of the petitioner who is an accused in connection with Saraiya PS Case No. 271 of 2015 for the alleged offences punishable under Sections 419, 420, 467, 468, 471, and 414/34 of the Indian Penal Code.

Learned Senior Counsel appearing on behalf of the petitioner submits that the petitioner came to be arrested by the police on the basis of information that a gang of ATM changers had collected near Axis Bank and on the basis of the confessional statement of the petitioner, he along with another person came to be arrested. From the possession of the petitioner,

Patna High Court Cr.Misc. No.47372 of 2015 (2) dt.16-10-2015 2/2 one ATM card of Bank of India was recovered. Learned Senior Counsel submits that there is no allegation against the petitioner that he had drawn any amount using any ATM card fraudulently. Referring to paragraph-3 of the petitioner, he submits that the petitioner has no criminal antecedent.

In view of the submission as above, this application is allowed.

Let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Muzaffarpur (West) in connection with Saraiya PS Case No. 271 of 2015. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
