JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Hathauri P.S. Case No. 72 of 2019 registered for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code.

Allegation against the petitioners, who happen to be sister-in-law (Gotni) and brother-in-law of the deceased, is of causing death of the deceased along with other accused persons. Submission of learned counsel for the petitioners is that as a matter of fact she died due to accidental fire and they were not present at the time of occurrence and all the family members have been made accused in this case and in support of his contention he has drawn my attention towards Annexure-2,

Patna High Court CR. MISC. No.60698 of 2019(2) dt.24-09-2019 2/2 which is pass book of the Bank and the same disclosed that they are residing at Delhi.

Heard learned APP also.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Sri Deepak Kumar, Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Hathauri P.S. Case No. 72 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
