This application for grant of anticipatory bail arises out of Islampur P.S. Case No. 152 of 2016, disclosing offences under Section 7 of the Essential Commodities Act.

Petitioner is a P.D.S. Dealer. In course of search conducted by the Supply Inspector, of the petitioner's shop, 50 Kg. of rice was found to be less than that mentioned in the Stock Register. It is also alleged that the said rice was fraudulently shown to have been distributed for the purpose of sell. Considering the nature of submission and the statement that the petitioner has no criminal antecedent, this application is allowed. Let the petitioner above named in the event of his

arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa at Nalanda in Islampur P. S. Case No. 152 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
