Public Prosecutor for the State assisted by learned counsel for the informant.
Petitioner seeks bail in a case registered under sections 302 and 120B/34 of the Indian Penal Code.
Petitioner is not named in the first information report but subsequently, when statement of mother of the deceased was recorded, she claims to have seen the petitioner roaming near her house and she disclosed that prior to alleged occurrence, petitioner had given threatening.
It appears that except the above stated two circumstances, there is nothing against the petitioner who is languishing in jail custody since 9.7.2016 without having any criminal antecedent. Moreover, having more or less similar allegation co-accused Gopal Mandal has already been granted privilege of bail.
Patna High Court Cr.Misc. No.42236 of 2016 (4) dt.09-12-2016 Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Begusarai Town P.S.
