2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 191, 192, 193, 196, 199, 200, 209, 415, 417, 465, 466 and 468 of the Indian Penal Code.
3. The complaint petition filed by the Deputy Registrar of the Patna High Court dated 18.05.2024 contained the recital that this Court vide order dated 20.03.2024 directed the petitioner to appear through VC on 03.04.2024 in connection with MJC No. 1205 of 2022. An affidavit was sworn by the petitioner submitting that the Court making statement that
Patna High Court CR. MISC. No.69469 of 2024(2) dt.17-10-2024 2/3 Kamlesh marked his attendance on 07.11.2022 to 01.12.2022. This Court directed to secure original record of that attendance register and it was observed by the High Court on 26.04.2024 that the attendance registered was created in contrast through Director, Jan Shiksha Report dated 16.04.2024. It is alleged that the petitioner produced fabricated documents and sworn false affidavit and this acted in a fraudulent manner and committed culpable obstruction in administration of justice.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the petitioner has already superannuated on 31.05.2024. He further submits that no inquiry was made by the concerned magistrate into the allegation against the petitioner and the cognizance was taken in a mechanical manner without affording the petitioner an opportunity to be heard. He submits that the petitioner is ready to cooperate in the trial. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstances of the case, let the above named petitioner in the event of his arrest or
Patna High Court CR. MISC. No.69469 of 2024(2) dt.17-10-2024 3/3 surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Complaint Case No. 136 (O) of 2024, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. with further condition that the petitioner shall cooperate with the investigation, if not already concluded and make himself available and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail.
