In the present writ petition, the petitioner is challenging the action of the respondents for initiation of departmental proceeding under the apprehension with the opinion of the District Magistrate, Gaya.

When a proceeding is initiated it will be a quashi judicial matter and the authority will conduct the enquiry without being influenced by any opinion or observation of any authority.
