This is a petition for grant of regular bail for offence under Section 395 of the Indian Penal Code. The first information report of robbery is against unknown persons. Name of the petitioner has transpired in the confessional statement of the co-accused, Ganauri Yadav. The petitioner has sated on oath that he has got no criminal antecedent and is in custody since 10.01.2017, neither anything has been recovered from his possession nor he was put on test identification parade. Ganaury Yadav has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No. 12681 of 2017. Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection
Patna High Court Cr.Misc. No.16820 of 2017 (2) dt.11-04-2017 2/2 with Chwara P.S. Case No. 7 of 2015 to the satisfaction of the Subdivisional Judicial Magistrate, III, Sheikhpura, or successor Court subjects to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the Court, concerned, and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
