2. The petitioner seeks bail in a case registered for the offence punishable under Sections 191(2), 191(3), 190, 109(1), 103(1), 118(1) and 352 of the Bharatiya Nyaya Sanhita, 2023.

Allegation in the first information report is that all the accused persons came variously armed and surrounded the informant, his brother Vikash Kumar and his grandfather Ajit Yadav and three accused persons including the petitioner put gamcha around the neck of the informant's brother and started dragging him. Further, co-accused Laljit Singh fired

Learned counsel for the petitioner submits that it would be apparent from the first information report itself that the allegation of firing shot at the brother of the informant Vikash Kumar, who later succumbed to the injury has been specifically attributed to co-accused Laljit Singh and so far as the role of the petitioner is concerned, it remains confined to the fact that he along with others put gamcha around his neck and dragged him. However, it is submitted that no mark of any violence has been found on any part of the body as would be evident from the inquest report as also the postmortem report of the deceased which indicates a single firearm injury on the chest which is attributed to co-accused Laljit Singh. Further, the learned counsel has also pointed to paragraph 16 of the case diary to contend that the injured Ajit Yadav has also not mentioned about the the petitioner being specifically involved in the offence in question.

5. Learned APP for the State and learned counsel for the informant opposed the grant of bail on the ground of the allegations mentioned in the first information report as also material collected during course of investigation.

No.61325 of 2025(4) dt.15-11-2025 3/3 also considering that there is no specific allegation on the petitioner with regard to firearm injury caused on the deceased which led to his death coupled with the fact that there is case and counter case and the petitioner is in custody since 10.06.2025 with no criminal antecedent and the charge-sheet having been submitted, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Deepnagar P.S. Case No.241 of 2025.
