JUSTICE VIKASH JAIN ORAL JUDGMENT Date : 25-08-2020 Heard learned counsel for the petitioner and learned counsel for the respondents through video conference.
2. The present writ petition has been filed "for issuance of an appropriate writ/writs, direction or directions or order or orders directing respondents to pay family pension to the petitioner after the death of her father and mother."
3. It is submitted on behalf of the petitioner that her father was a Professor in the Statistics Department of Tilka Manjhi Bhagalpur University, Bhagalapur and died on 11.05.2000. Her mother was granted family pension but thereafter she died on 16.01.2018. The petitioner is now alone with no source of income and the respondent-University has arbitrarily stopped the pension benefits. A representation dated 03.05.2018 has been filed in this regard before the Registrar, Tilka Manjhi Bhagalpur University (respondent no.4) which is pending.

Having regard to the nature of grievance of the petitioner, this Court is of the view that without going into the detailed merits of the matter, it will suffice at this stage if the Registrar, Tilka Manjhi Bhagalpur University (respondent no.4) )is directed to consider and dispose of the petitioner's representation dated 03.05.2018 (Annexure-2), if still pending, on its own merits in accordance with law after grant of an opportunity of hearing to the petitioner ensuring payment to the extent found due to the petitioner, within a period of eight weeks from today. In case the petitioner's claim is found inadmissible, whether in whole or in part, the petitioner's representation shall be disposed of by a speaking order in that regard. To enable the same, the petitioner shall furnish her mobile number and e-mail ID to the respondent no. 4 within a week from today.
5. It is also made clear that in view of the ongoing Covid-19 pandemic, any correspondence between the parties may be made through email and that the concerned authority shall be at liberty to hear the petitioner through video conference.
6. The writ petition stands disposed of with the aforesaid directions.
