Mr.Ajay Mishra ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This is an application for grant of anticipatory bail in connection with Paraiya P. S. Case No. 16 of 2019, disclosing offence under Section 409 of IPC.
F.I.R. disclosed that a general direction was given to the Panchayat Secretary to deposit the folder relating to appointment of Panchayat Teachers and name of the petitioner also found in the list, but the Panchayat Secretary was not deposited the folder.
Submission of the learned counsel for the petitioner is that he has already retired in the year 2005 and at that time, there was no appointment to the Panchayat Teacher, rather Panchayat Siksha Mitra was appointed. Further submission is that his name has falsely been found in the list. He is ready to co-operate the authority concerned.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-II, Gaya, in connection with Paraiya P. S. Case No. 16 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that he has to co-operate the authority concerned in the departmental enquiry.
