2. The petitioner seeks bail in connection with Ramnagar P.S. Case No. 291 of 2025 registered for the offence under Sections 103(1), 61(2)a and 3(5) of the BNS.

3. As per the prosecution case, the deceased has died in the clinic of the petitioner during the course of treatment because of pregnancy complications.

4. The petitioner is in custody since 06.06.2025.

5. It has been submitted by the learned counsel for the petitioner that the petitioner is a midwife and during the course of delivery the patient died.

6. Considering the fact that the petitioner is a woman and the period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bagaha, West Champaran/concerned Court below in connection with Ramnagar P.S. Case No. 291 of 2025.

8. As a condition of this order, the petitioner is directed to give an undertaking in the Court below at the time of furnishing bail bonds that she will not indulge herself in medical practice in future. In case, the petitioner violates the terms of bail then the same will result in automatic cancellation of the bail bonds of the petitioner.
