JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner as well as learned APP for the State.

Informant, Rajendra Prasad Singh along with his full brother, Binay Kumar Singh had gone to the place of petitioner, Fulena Singh in order to demand Rs. 5 Lacs which he had borrowed and during course thereof, it has been alleged that all the accused so named therein having been variously armed began to abuse. When protested, Fulena Singh caught hold of his brother, Binay Kumar Singh and then Dilip Kumar assaulted Binay Kumar Singh with iron rod which caused injury near left eye, temporal region on account of which, he became unconscious. Sanjit Kumar fired. Rest of the accused chased to assault whereupon informant escaped therefrom. On hue and cry, witnesses came who lifted Binay to PHC, Ramgarh Chowk and from there to Sadar Hospital,

Patna High Court Cr.Misc. No.43740 of 2016 (2) dt.06-10-2016 Lakhisarai and then thereafter, Binay was referred to PMCH. Considering the allegation levelled against the petitioner to be that of abettor along with period of custody since 31.07.2016, petitioner, Fulena Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai (Ramgarh Chowk) PS Case No. 36/2016, G.R. No. 96 of 2016.
