The petitioner seeks bail in a case for the offence punishable under section 13 of the U.A.P. Act. Allegedly, some unknown persons gave a pamphlet to the informant demanding levy of Rs. 3,00,000/-. Submission is of false implication and that the petitioner is not named in the FIR, his name has come in the confessional statement of co-accused Vikki Paswan and Rakesh Paswan, nothing has been recovered from possession of the petitioner and he is suffering in custody since 03.08.2015. Coaccused Vikki Paswan and Rakesh Paswan have been allowed bail vide Cr. Misc. No. 43136 of 2015 and as such the petitioner also

Patna High Court Cr.Misc. No.48690 of 2015 (3) dt.04-12-2015 2/2 deserves sympathetic consideration, to which the learned A.P.P. does not dispute.

In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. Arwal (Jehanabad) in Kinjar P.S. Case No. 10 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
