JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-10-2019 This is an application for grant of anticipatory bail in connection with Alipur P. S. Case No. 35 of 2019, disclosing offences under Sections 341, 323, 307, 354 and 504 of the Indian Penal Code.

As per F.I.R. it appears that the dispute arose while playing the cricket and there is allegation against the petitioners of assault to the informant and specific allegation of assault is against co-accused Shri Ram.

Submission of the learned counsel for the petitioners is that there is case and counter case between the parties and the impugned order itself disclosed that there are dispute with respect to money collected for organizing cricket match. Further

Patna High Court CR. MISC. No.61944 of 2019(2) dt.15-10-2019 2/2 submission is that no specific allegation has been attributed against these petitioner and specific allegation against coaccused Shri Ram. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate-II, Gaya, in connection with Alipur P. S. Case No. 35 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
