Learned counsel for the petitioner undertakes to remove the defects, if any, within three weeks. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 307, 427 and 506/34 of the Indian Penal Code, Section 27 of the Arms Act and Sections 3, 4 and 5 of the Explosive Substance Act. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is no specific overt act against the petitioner. He submits that there is general and omnibus allegation levelled against the petitioner. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.

Patna High Court CR. MISC. No.700 of 2022(4) dt.05-12-2022 2/2 Learned APP for the State opposes the prayer for bail and submits that the offence is serious in nature and petitioner do not deserve bail and all the witnesses have supported the prosecution case. He further submits that the police has also found explosive on the spot.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Rampur P.S. Case No. 434 of 2017, (Anjani Kumar Sharan, J) devendra/- U T
