The petitioner apprehends his arrest in Gardanibagh P.S. Case No.40 of 2016 registered under Sections 341, 323, 379, 411, 504 and 34 of the Indian Penal Code.
As per the prosecution case, the petitioner along with other accused persons are said to have snatched the motorcycle of the informant.
It has been submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. No recovery has been made from his conscious possession. The petitioner's name came in this case on restatement of the informant. The allegation against the petitioner is general and omnibus in nature. The co-accused who has been apprehended with the motorcycle
Patna High Court Cr.Misc. No.19613 of 2017 (04) dt.22-06-2017 2/2 has been enlarged on bail by this Court in Cr. Misc. No.21450 of 2016 vide order dated 15.07.2016.
Considering the facts aforesaid and the nature of allegation as made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000.00 (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned J.M. 1st Class, Patna in Gardanibagh P.S.
