2. The petitioner apprehends his arrest in a case registered for offence under Sections 147, 148, 149, 341, 323, 337, 338, 332, 333, 353 and 307 of the Indian Penal Code. 3 . As per F.I.R., four named including this petitioner and 10 unknown persons attacked the police personnel with lathi, danda and iron rod, as a result of which , one Home Guard sustained injury.

4. Learned counsel for the petitioner submits that allegation is general and omnibus against this petitioner. No specific overt act is alleged against this petitioner. Petitioner claims clean antecedent.

5 . Learned counsel for the State opposes the bail

Considering the aforesaid facts, clean antecedent of petitioner and other circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM- I Danapur Patna in connection with Danapur P.S. case No. 1073 of 2023 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
