2. In this case, the petitioner is seeking regular bail in connection with Thawe P.S. Case no. 11 of 2024 instituted for the offence under Sections 399, 402 of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act.

3. On the basis of secret information, the informant, PSI of Thawe Police Station, conducted a raid near Sihorwa Siphon where 10-12 unknown persons were allegedly gathered with motorcycles. On seeing the police, all tried to flee. Three persons were apprehended and two motorcycles were seized. During search, one country-made pistol was recovered from co-accused Pappu Nat, while nothing incriminating was recovered from Ranjan Nat. The arrested persons disclosed the names of other accused, including the

Patna High Court CR. MISC. No.64286 of 2025(4) dt.19-01-2026 2/2 petitioner, who allegedly fled away from the spot.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. Nothing has been recovered from his possession. Co-accused Raju Kumar, from whose possession, the motorcycle was recovered, has been granted bail by a coordinate Bench of this Court vide order dated 02.12.2024 in Cr. Misc. No. 79205 of 2024 and the case of the case of the petitioner is on better footing to that of co-accused Raju Kumar.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.D.J.-IX, Gopalganj / concerned court below in connection with Thawe P.S. Case no. 11 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
