JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-11-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147,149, 323, 324, 307, 379 of the Indian Penal Code. It is alleged that accused persons entered into the house of the informant when these petitioners assaulted with Dab to the mother-in-law of the informant and when Amzad Ali came to rescue then an attempt was made to assault him also but he could not receive injury. Co-accused Rauzan and Shabnam snatched gold chain of the informant and made assault.
It is submitted by learned counsel for the petitioners that petitioners are agnate of the informant and for a petty dispute the accusation has been levelled. The motherin-law of the informant has received only one incise injury,
Patna High Court Cr.Misc. No.47889 of 2015 (2) dt.04-11-2015 2/2 simple in nature, but accusation is that petitioner Nos. 1 and 2 made assault with Dab, a sharp cut weapon. The injury report of the informant suggests only pain in left wrist joint and body. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the nature of accusation and the nature of injury caused to the informant's side, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S. Case No. 292 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
