2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 25(1-b)a, 26(2) and 35 of the Arms Act, registered in connection with Parbatta P.S. Case No. 133 of 2024.

3. As per prosecution case, there has been recovery of one loaded rifle from the possession of the petitioner.

4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and has committed no offence. Petitioner has no concern with the alleged recovery of arms. On the basis of suspicion, he has been made accused in this case. No incriminating article has been

Patna High Court CR. MISC. No.65937 of 2024(2) dt.24-09-2024 2/2 recovered from the conscious possession of the petitioner and he is in custody since 05.04.2024. From perusal of the para-3 of the petition, it appears that the petitioner having one criminal antecedent but not of similar nature.

5. Learned APP for the State has opposed the prayer of bail.

Considering the above facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-I, Khagaria in connection with Parbatta P.S. Case No. 133 of 2024, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
