Mr.Mohammed Arif ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-12-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Akbarnagar P.S. Case No.21 of 2019 for the offence registered under Sections 379, 411 and 414 of the Indian Penal Code. The allegation is regarding recovery of stolen motorcycle from co-accused person, namely, Nisar Alam and after he was apprehended by the Police, he had confessed his crime as also had named the petitioner to be one of his accomplice.

The learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that the petitioner is languishing in custody since 11.04.2019 and the fact is that the

No.58750 of 2019(3) dt.12-12-2019 2/2 said co-accused person, namely, Nisar Alam, from whose possession stolen motorcycle has been recovered, has already been granted bail by a coordinate Bench of this Court by an order dated 27.09.2019 passed in Criminal Misc. No. 44551 of 2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-1st, Bhagalpur in connection with Akbarnagar P.S. Case No. 21 of 2019.
