JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-05-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in Natwar P.S. case No.81/16 for the offence under Sections 341,323, 498A and 302/34 of the I.P.C.

Accusation is of torturing of the daughter of the informant by her husband and in-laws due to non -fulfillment of demand of she buffalo and golden chain.

Learned counsel for the petitioners submits that both the petitioners are father-in-law and mother-in-law of the deceased who died after 15 years of her marriage. He further submits that, in fact, daughter of the informant was carrying pregnancy of

No.17066 of 2017 (2) dt.16-05-2017 2/2 about nine months and she complained of severe pain when her condition became precarious, she was taken to hospital but on the way she died. In the post mortem report no external injury was found and the doctor also found rapture of uterus and internal bleeding and matured dead female foetis. When the informant was also informed about her illness he came to her matrimonial house after death of her daughter. But with ulterior motive he lodged the present case.

Considering the facts and circumstances of the case, let the petitioners, in the event of their arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of J.M. 1st Class, Bikramganj, Rohtas, in Natwar P.S.Case No.81/16 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
