The petitioner apprehends his arrest in connection with Complaint Case No. C1-202 of 2015 registered under Section 419, 420 and 120B of the Indian Penal Code.
The allegation of complainant is that Khata No. 232 Area 8 decimal is recorded in the name of Birendra Singh. The said land belongs to the complainant on the basis of Homestead Receipt issued by the Circle Officer, Piprahi. The complainant is in possession over the said land more than 25 years. Later on, he came to know that on 03.12.2014 accused Tejnarain Kunwar executed the sale deed in favour of accused persons namely Sakur
Patna High Court Cr.Misc. No.43567 of 2016 (2) dt.05-10-2016 2/2 Ansari, Jahur Ansari, Akhtar Ansari and the Adud Ansari, on which this petitioner put his signature on the sale deed as witness. Learned counsel appearing on behalf of the petitioner submits that it would appear that the sale deed, on which the petitioner has put his signature, was executed on 03.12.2014 by Tejnarain Kunwar, whereas the Homestead Receipt was issued by the Circle Officer vide case No. 10/14-15, after execution of the sale deed.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Sheohar in connection with Complaint Case No. C1-202/15, Tr. No. 1089 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
