The petitioner apprehends his arrest in connection with Kanti P.S. Case No.481 of 2021, registered for the offences punishable under Sections 302/34 of the Indian Penal Code. The petitioner and other co-accused persons are said to have killed the son of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that there is no eye witness of the occurrence and only on suspicion, the petitioner has been made accused in this case. It is also submitted that the petitioner

Learned APP for the State as well as learned counsel for the informant opposed the prayer for anticipatory bail of the petitioner and submitted that there are 13 injuries on the body of the deceased and the doctor opined that the deceased died due to said injuries.

Taking into consideration the facts aforesaid and the fact that the petitioner is aged about 73 years, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Muzaffarpur (West) in connection with Kanti P.S. Case No.481 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. It is made clear that this order may not be treated as a precedent for future reference.
