The Petitioner seeks bail in Basantpur P.S. Case No. 269 of 2016 instituted for the offence under Section(s) 379/411 of the Indian Penal Code.

As per written report, the petitioner is not named in the First Information Report.

From the order of the Sessions Judge, it appears that after arrest of this petitioner, the police recorded his confessional statement. It is mentioned in the impugned order itself that the alleged tractor has been recovered from co-accused Ajay Paswan at the instance of co-accused Ashok Chaudhary as appears in para 69 of the case diary.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Basantpur P.S. Case No. 269 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
