2. Heard learned counsel for the petitioner and Mr. Jharkhandi Upadhyay, learned Additional Public Prosecutor for the State.

3. The petitioner is in custody since 30.07.2023 in connection with Chiraiya P.S. Case No. 364 of 2023 registered for the offence punishable under Sections 341/323/307/379/ 504/34 of the Indian Penal Code.

4. As per the prosecution case, the allegation against the petitioner is of assaulting the uncle of the informant, namely, Ashok Rai and others.

5. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case due to village

6. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail. He submits that the uncle of the informant has sustained grievous injury.

7. Considering the facts and circumstances of the case and also the period of custody, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Motihari, East Champaran in connection with Chiraiya P.S. Case No. 364 of 2023.
