2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 309(4) and later on added Section 317(3) of Bhartiya Nyay Sanhita.

3. According to the case of prosecution, altogether Rs. 3,90,000/-( three lakh and ninety thousand) was looted from the bag of the informant by some miscreants.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He is not named in F.I.R. rather his name has surfaced in this case on the basis of confessional statement of co-accused Niraj Kumar before the

Patna High Court CR. MISC. No.71933 of 2024(2) dt.05-10-2024 2/2 police which has got no evidentiary value in the eye of law. The petitioner was not apprehended on the spot. He has got no criminal antecedent. Moreover, the petitioner is languishing in judicial custody since 10.07.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Chanpatiya P.S. Case No. 162 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Bettiah, West Champaran.
