The petitioners seek bail in connection with Sakari P.S. Case No. 171 of 2021, registered for the offence under Sections 272, 273, 420, 467, 468, 471, 120(B), 414 of the Indian Penal Code and Section 30(a), 36, 41(i) of Bihar Prohibition and Excise Act.

As per prosecution story, 4419.36 litres of foreign liquor has been recovered from a truck of which petitioner No.1 is driver and petitioner No.2 is Khalasi.

It is submitted on behalf of the petitioners that nothing has been recovered from the conscious possession of the petitioners. They were not aware of the nature of assignment

Patna High Court CR. MISC. No.672 of 2022(2) dt.21-03-2022 2/2 which was being transported by the vehicle in question. They claimed to be clean antecedent and they are in custody since 29.08.2021.

Considering the period of custody and clean antecedent of the petitioners, the bail petition of the petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J.-2nd-cum-Spcial Judge, Excise Act, Madhubani, in connection with Sakari P.S.
